Collection and Use of Personal Information and Data.  During the quoting and application, or during the use of the life insurance quote tool or life insurance calculator, you may give us personal information such as your: name, address, phone number, e-mail address, social security number, driver’s license number, date of birth, height, weight, ethnicity, medical history, family history, income level and asset level. ABA collects personal information to educate consumers and provide life insurance services. ABA will not sell, disseminate, disclose, trade, transmit, transfer or share any personally identifiable information about you to or with any third party unless the release of such information is:  (1) specifically authorized by you; (2) necessary to provide life insurance quotes or to complete the life insurance transactions requested by you; (3) to conduct marketing activities and communicate with you regarding products and services offered by ABA and its service partners; (4) required either by law or to comply with legal process served on ABA; (5) necessary to protect or defend the rights or property of ABA; (6) required by exigent circumstances or to protect individual personal safety or the public; or (7) otherwise permitted by this Policy or applicable law.

ABA may gather analytical data on website usage, physical location, browser usage, device identifiers, search history, and IP addresses. ABA may share data with service providers to help it perform statistical analysis, send you e-mail or postal mail, provide customer support or arrange for delivery of other information.  ABA also may share your personal information with insurance companies in order to obtain insurance quotes for you.  All such third parties are prohibited from using your personal information except to provide these services to ABA and are required to maintain the confidentiality of your personally identifiable information.  ABA may contact you, from time to time, on behalf of itself or external business partners, about a particular product, service or offering that may be of interest to you.  If you give ABA your e-mail address, ABA may use it from time to time to notify you of such things as new services, special offers or to confirm transactions.  If you do not wish to be contacted by e-mail for non-policy related communications, you may unsubscribe by following the instructions at the bottom of any ABA e-mail you receive.

Product Restrictions and Limitations.  Certain policies and products may not be available in all states, and additional restrictions or limitations may apply. The quote, policy and plan comparisons and information we provide are furnished by the individual insurance companies, and are subject to change without notice and/or underwriting qualification by the specific insurance company to which the application is submitted. A quote should not be construed as a commitment from the insurance company to actually issue that policy or any other policy to you. All quotes that we present are based on the information you have provided to us.  You are responsible for ensuring the information you provide in connection with any quote or inquiry through the Website is accurate and complete. You may change or edit your information on our Website by contacting us at the address below.  To purchase an insurance policy, you must submit a completed application to the insurance company, which will then review and underwrite your application along with any other information that may be gathered from sources such as, but not limited to, credit bureaus and medical providers. Following that review and underwriting analysis, the insurance company will then determine whether you are eligible for insurance and, if so, the precise premium to charge you for the insurance policy you seek. This underwriting process may result in higher or lower premiums than your quote.

Transfer to Subsequent Owner.  We reserve the right to disclose and transfer all such information: (1) to a subsequent owner, co-owner or operator of this Website or applicable database; or (2) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.  Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Policy unless you agree otherwise.

ABA Trademarks.  ABA trademarks, tradename, the ABA logo, all page headers, graphics, images, symbols, tag lines and other ABA marks found at the Website are the proprietary property of ABA (collectively the “Marks”).  ABA WOULD NOT CONSENT TO YOUR USE OF THIS WEBSITE BUT FOR THESE WARRANTY DISCLAIMERS AND LIMITATION OF ABA’S LIABILITY WITH RESPECT TO THE WEBSITE.

Remedies.  You acknowledge and agree that a violation of the restrictions set forth in this Policy will result in irreparable injury to ABA.  Accordingly, ABA will be entitled to preliminary and permanent injunctive relief for a violation or threatened violation of any provision in this Policy without having to prove actual damages or to post security or a bond.

Termination.  ABA reserves the right to suspend or terminate your use of or access to any portion of or all of the Website at any time with or without notice for any reason whatsoever.

Governing Law.  This Policy is governed by the substantive and procedural laws of the Commonwealth of Pennsylvania.

Jurisdiction and Venue.  Any action, claim or proceeding against ABA relating to this Policy, the Website or regarding a disclosure of personal information must be brought by you in the state court in the Commonwealth of Pennsylvania, Montgomery County, or the federal court for the Eastern District of Pennsylvania located in Philadelphia.  You consent to this jurisdiction and venue and waive any objection to such jurisdiction and venue, including as to an inconvenient forum.

Severability.  This Policy is in all respects severable.  Should any term or provision be deemed by a court to be unlawful or unenforceable, such term or provision may be revised by the court as necessary to make such provision lawful and enforceable or, if such revision is impossible, the term or provision will be deemed deleted from this Policy without affecting any other provisions of this Policy.

Changes.  ABA reserves the right to and may modify, amend or update this Policy from time to time without advance notice to you.  This Policy will be available on the Website and ABA recommends you review the Policy each time you visit the Website.
